TERMS AND CONDITIONS OF YOUR CONTRACT WITH US

1. The Contract
When you purchase any of the travel services and packages from Accessible Escapes, you are confirming that you understand and have accepted the information we provided you regarding your purchase. You are also accepting that our terms and conditions form the basis of the contract between Accessible Escapes and you. The purchaser must confirm that he/she has the authority of all the persons included in the vacation to make the reservation on their behalf. The person who makes the reservation accepts responsibility for making payments to Accessible Escapes for all members of the party and will receive all documents and other information from us on behalf of the party.

2. Making A Reservation
A provisional reservation will be accepted by telephone, fax or e-mail, which will be held for an agreed period by Accessible Escapes. This reservation will be confirmed in writing by Accessible Escapes upon receipt of appropriate deposits and/or balance payments. Please check the invoice carefully to ensure that it is correct and let us know immediately if you notice any discrepancies.

3. Payment
When you purchase a vacation package, product or service with Accessible Escapes, you pay for the item in-full at the time of purchase. For your protection, we ask that anyone who books travel through Accessible Escapes purchase and maintain COMPREHENSIVE TRAVEL INSURANCE. This policy must include cancellation cover; 24-hour medical and emergency service, repatriation and a 24-hour emergency telephone help line. Travelers should provide details of their insurance to Accessible Escapes 30 days prior to departure. Please make sure the insurance covers any pre-existing medical conditions (past and present) and check for any exemptions. If you are bringing a wheelchair, please ensure there is sufficient insurance to cover it in the policy. When you purchase an AE Extraordinary Tour or customize your own tour, you agree to purchase and maintain this travel insurance for the duration of your trip.

4. Amendments
Until your reservation has been confirmed, we reserve the right to make any necessary changes. You will be informed immediately if we need to make any changes to your reservation. After your reservation is confirmed, we will take reasonable steps to make the changes you request.

5. Cancellation By You
Things come up. We understand that at Accessible Escapes, and rest assured, you can cancel your vacation at any time. If you wish to cancel your vacation, this must be done in writing by the person who made the reservation. The date of cancellation is the date the letter is received in this office. When you purchase a vacation with Accessible Escapes, you pay for the tour in full at the time of purchase. Due to the fact that we have to pay many of our vendors in advance, if you need to cancel your trip, you will be subject to the cancellation fees listed below based on the number of days before departure we receive your cancellation letter.

More than 2 months – 10%
Between 35 days and 2 months - 40%
Between 22 days and 34 days - 70%
Between 14 days and 21 days - 90%
14 days and less - 100%

If you cancel for a reason covered by your insurance policy you should make a claim against the insurance company.

When the price of your vacation is based on the number of people booked and a cancellation alters that number, then we will recalculate the invoice based on numbers actually travelling. No refund will be given on any unused portion of the reservation.

6. Cancellation/Alteration By Us
Because we plan arrangements months in advance, we reserve the right to make changes if absolutely necessary. Most changes are minor such as the withdrawal of a facility; the need to change your hotel to another of the same official category; a change of routing/carrier or a change to/cancellation of an event (such as an excursion) at your destination. We will let you know about this kind of change as soon as possible but we do not pay compensation for minor changes.

If we have to make a major change such as: an alteration to the departure time of your transport or a change of accommodation to a lower category, we will inform you immediately and we will refund the difference in price if there is one.

In the event a major change takes place, you will be entitled to compensation as detailed in the paragraph above, unless the change or cancellation is caused by circumstance beyond our control, such as bad weather, airport closures, industrial action, the hotel being closed, epidemic, civil strife , labor strikes, or terrorist activity, fire, flood, war, threat of war, natural or nuclear disaster.

*Important note: In respect of all vacations booked, Accessible Escapes will not be responsible for any out-of-pocket expenses or consequential or indirect loss you incur as a result of any change. We will not pay you any compensation if you have not paid the full amount for your vacation 60 days before departure. In the event of a change to an accommodation only reservation, Accessible Escapes will be liable only in relation to the accommodation booked and we will not be responsible for any indirect costs or losses or other out-of-pocket expenses incurred.

7. The Price
All prices are correct at the time of going to press but are subject to change if payment-in-full has not been received 60 days in advance.

8. Descriptions
All descriptions of properties and services are made in good faith and every care is taken to ensure their accuracy. However, owners of properties, amenities, tourist sites, activities may change their services from time to time and without notice and Accessible Escapes shall not be responsible if amenities mentioned on the website are not available. We notify you of changes of which we become aware prior to departure. If we are aware of building work or unusual noise at the hotel you will be advised before you depart.
All accommodations listed on our website have been inspected by Jennifer and Loredana personally to assure that the accommodation is suitable for use by a wheelchair user or “Slow Walker.” However, abilities vary considerably and it is your responsibility to make known to Accessible Escapes all special requirements you have. See Paragraph 13. Accessible Escapes will not be responsible for any changes to the properties or their contents after the date of inspection.

9. Travel Insurance
For the protection of your party it is a condition of reservation that all members must take out COMPREHENSIVE TRAVEL INSURANCE. This policy must include cancellation cover; 24-hour medical and emergency service, repatriation and a 24-hour emergency telephone help line. Clients arranging their own insurance must do so immediately thereby covering for the possibility of cancellation and subsequent loss of monies. Clients must provide details of their insurance 60 days prior to departure.

10. Vacation Accommodations
All villas, hotels and apartments offered by Accessible Escapes are privately owned, and we act as an agent for the owners, or their representatives. Only those persons named at the time of reservation may occupy the property. Breakages or damage must be reported to our local agent immediately and the appropriate payment or replacement made locally before departure. We will require a credit card number as security. If there has been a breakage or damage at a villa, hotel or apartment a claim may be made against you for the full cost of any replacement items or repairs. We reserve the right to charge for any breakage or damage, which is discovered after you have vacated the property and which has not been reported.

11. Flight Arrangements By Third Parties
Scheduled flights and some other services are subject to the terms and conditions of the carriers, some of which may limit liability. Should you be advised of any changes to flight schedules by the airline, tour operator or consolidator, you must inform us immediately in order that appropriate arrangements can be made for your arrival at the resort. IMPORTANT NOTE: Aircraft types are subject to change without notice by the airlines.

12. Claims & Liability
Any claim under this agreement shall be subject to American Law and all proceedings shall be within the exclusive jurisdiction of the American Courts. As part of our undertaking to provide your required vacation arrangements, it is necessary for Accessible Escapes to select and make arrangements with various independent contractors including hoteliers and coach transport operators. Accessible Escapes is not responsible or liable for the negligence or other acts or omissions of those independent carriers, the hoteliers or other contractors, or their employees or agents.

13. Special Requirements
Whenever possible, we will provide pictures, measurements and descriptions of all hotel rooms so you are able to decide if the accommodation is appropriate to your ability level. If you need additional information or have specific dietary requests, please inform Accessible Escapes at the time of your purchase. We will accommodate your needs as best we can and inform you if there are any issues making the accommodation.

14. Data Protection
In order to process your reservation it is necessary for us to collect personal data from you and members of your party. In order to arrange your vacation, we may have to pass some of that information on to the relevant suppliers of your travel arrangements. Such suppliers may be outside the United States. We may contact you or members of your vacation party in the future to inform you about our services. If you do not wish to receive such information in the future then please email us. By signing the reservation form you confirm your consent to the use of your data and that of your party members for these purposes.

15. Complaints
If you have a complaint about your vacation you must tell our local guide or concierge and/or Accessible Escapes on the emergency telephone number immediately. If you fail to do this we cannot accept responsibility as we may have lost the opportunity to investigate and rectify the problem. You must also write to Accessible Escapes within 30 days of your return with full details of your complaint.

16. Locally Hired Equipment & Facilities
Where requested, Accessible Escapes will make arrangements on your behalf the hiring of equipment from local suppliers or medical services such as wheelchairs, nursing, oxygen supplies or dialysis when possible. Accessible Escapes accepts no responsibility for ensuring that this equipment or these services will be available for you or will be suitable for your requirements. Unless otherwise stated you will be responsible for paying the local supplier and you should ensure that you take sufficient local currency for this purpose. Any loss or damage caused by the equipment which you hire or services provided to you will be the responsibility of the local supplier and Accessible Escapes accept no responsibility for the selection or fitness for purpose of the equipment or services supplied or for any loss or damage caused by its use.

IMPORTANT INFORMATION

It is necessary that all persons on medication or under medical treatment obtain permission to travel from their doctor. Some airlines require a certificate confirming `fitness to fly`. If anyone in your party plans to participate in any athletic excursion, hiking, basketball, etc, it is necessary to obtain a certificate confirming fitness for participating in these activities. Accessible Escapes is not liable for any medical issues that arise during and throughout an Accessible Escapes vacation.

Insurance: It is a condition of reservation that you have adequate insurance coverage (see Terms and Conditions of Your Contract With Us, Section 9). You should read the insurance policy document carefully. It will give you full details of what is and what is not covered and the conditions of cover. Cover will vary from policy to policy and insurer to insurer.

Passports & Visas: It is the responsibility of clients traveling to ensure they have a valid passport with at least a 6-month duration beyond the return date to the United States. You should also check Visa requirements, as these may be necessary for passport holders of certain nationalities. Accessible Escapes cannot be held responsible for the canceling of any vacation as a consequence of incorrect or invalid documentation. No refunds will be given in such circumstances.

TERMS AND CONDITIONS OF SITE USE

This web site (the "Site") is maintained by the Accessible Escapes for your personal information, entertainment, and enjoyment. Please feel free to browse, download from, talk back to, and otherwise use the Site. At the same time, please remember that your access to the Site is subject to the following terms, conditions, and notices (the "Terms") as well as all applicable laws. By accessing and using the Site, you accept the Terms without limitation or qualification.

Accessible Escapes may at any time revise these Terms by updating this posting. You are bound by such revisions and should therefore visit this page to review the current Terms from time to time.
Accessible Escapes reserves the right, without notice and for any reason, to remove any content on the Site, and to deny access of any user or users to all or any part of the Site.

Images of people or places displayed on the Site are either the property of, or used with permission by, Accessible Escapes. Use of these images by you or other third parties is prohibited unless expressly permitted in the Terms or elsewhere on the Site. Any unauthorized use of these images may violate copyright laws, trademark laws, the laws of privacy and publicity, and other applicable regulations and statutes.

Trademarks

The names, words, titles, phrases, logos, trademarks or service marks, icons, graphics or designs or other content ("Trademarks") displayed on the Site are the property of Accessible Escapes and other parties, and may be registered and unregistered Trademarks of Accessible Escapes and others. Nothing contained on the Site should be construed as granting by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of Accessible Escapes or such third party that may own the Trademark. Misuse of any Trademarks, or any other content, displayed on the Site is prohibited. Miscellaneous

The Terms will be governed by and construed under the laws of the State of California, excluding only its conflict of law provisions. Each user accessing the Site hereby submits to the exclusive jurisdiction and venue of the courts within the County of Los Angeles, State of California, U.S.A., and waives any jurisdictional venue or inconvenient forum objections to such courts. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
Any failure by Accessible Escapes to enforce any of its rights under the Terms or applicable laws shall not constitute a waiver of such right. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, you, Accessible Escapes, and the court shall endeavor to give effect to the intent reflected in that provision, and the remaining Terms provisions shall retain their full force and effect.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Accessible Escapes as a result of this agreement or use of the Site. Accessible Escapes’ performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement is in derogation of Accessible Escapes' right to comply with law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Accessible Escapes with respect to such use. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. This Agreement constitutes the entire agreement between the user and Accessible Escapes with respect to this web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Accessible Escapes with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
